The petitioner apprehends his arrest in connection with Agamkuan P.S. Case no. 96 of 2017, registered under Sections 302, 201/34 of the Indian Penal Code.
The accusation is that the marriage of Pryanka Kumar, daughter of the informant, was performed with Shashmit Kumar in the year 2009, but she was being tortured for non-fulfillment of Rs. 3 Lakhs as dowry. After 3-4 years, she left the house and took a rented house near the house of Shailendra Prasad, Mausa of Sashmit Kumar and she was working in Noble Hospital. On 01.03.2017 staff of Noble Hospital informed to the mobile of informant that his daughter has been killed.
Learned counsel for the petitioner submits that petitioner is Mausi of the husband of the deceased and she has falsely been
Patna High Court Cr.Misc. No.41032 of 2017 (3) dt.07-12-2017 2/2 implicated in this case only on the basis that deceased was living near the house of husband of the petitioner. The petitioner has no criminal antecedent.
Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Addl. Chief Judicial Magistrate, Patna City, Patna in connection with Agamkuan P.S. Case No. 96 of 2017, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
