Mr.Ram Sumiran Rai, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE PURNENDU SINGH ORAL ORDER 06-08-2025 Heard Mr. Vaibhava Veer Shanker, learned counsel appearing on behalf of the petitioner and Mr. Ram Sumiran Rai, learned APP for the State.
2. Petitioner seeks regular bail in connection with Cyber P.S. Case No. 11 of 2025 registered for the offences punishable under Sections 303(2)/318(4) of BNS and Section 66/66(D) of IT Act.
3. As per the allegation made in the FIR, on secret information the police conducted raid and on seeing the police party, some persons tried to flee away but they were apprehended and petitioner was one of them. On search, mobile phones and date sheets were recovered from the possession of the apprehended persons from which it transpired that they are

4. Learned counsel appearing on behalf of the petitioner submitted that petitioner is innocent and has falsely been implicated in the present case. Only one mobile phone was recovered from the possession of the petitioner. Similarly situated co-accused Sishu Kumar, Lalmani Kumar, Mukesh Kumar, Raushan Kumar, Bittu Kumar and Sanjeet Kumar have already been granted bail by a co-ordinate Bench of this Court vide order passed in Cr. Misc Nos.32988 of 2025, 24417 of 2025, 29532 of 2025 and 27958 of 2025. Petitioner has clean antecedent and is in custody since 18.01.2025.
5. Learned APP appearing for the State opposes the bail prayer.

Considering the facts and circumstances of the case, as well as, considering the fact that similarly situated coaccused, as above-named, have been granted bail by a coordinate Bench of this Court, the learned District Court is directed to release the petitioner, above named, on bail upon furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J.-III, Nawada/concerned court in connection with Cyber P.S. Case No. 11 of 2025 subject to the following
Patna High Court CR. MISC. No.28390 of 2025(3) dt.06-08-2025 3/3 conditions:
(i) Bailors should be local having sufficient immovable property within the jurisdiction of the Court concerned.
(ii) Petitioner shall co-operate in the trial and shall be properly represented on each and every date fixed by the Court. (iii) If the petitioner tampers with the evidence or the witnesses of the case, in that case, prosecution will be at liberty to move for cancellation of bail of the petitioner. (iv) If the petitioner is found involved in similar nature of offence, after his release on bail, the trial Court shall take steps to cancel his bail bond.
(v) The learned District Court is directed to verify the criminal antecedent of the petitioner as stated in paragraph no. 3 of the bail application. If any other case is pending against the petitioner as what has been stated in paragraph no. 3, this order will lose its force automatically. (Purnendu Singh, J) Sanjay/- U T
