The petitioner is languishing in custody since 04.09.2018 in a case registered for the offences punishable under Sections 302, 120B/34 of the Indian Penal Code and Section 27 of the Arms Act. Subsequently, Sections 326/307 of the IPC were also added vide order dated 13.08.2014. The prosecution case is that the petitioner and coaccused persons made indiscriminate firing resulting into death of two persons and injury to several others. It is submitted by learned counsel for the petitioner

Patna High Court CR. MISC. No.28741 of 2019(5) dt.20-11-2019 2/3 that the accusation is omnibus and general. Moreover, other co-accused persons have been granted bail vide order dated 24.09.2015, passed in Criminal Miscellaneous No. 19589 of 2015, vide order dated 20.06.2018, passed in Criminal Miscellaneous No. 27307 of 2018, vide order dated 17.10.2017, Criminal Miscellaneous No.43057 of 2017, vide order dated 10.04.2015, passed in Criminal Miscellaneous No. 7948 of 2015 by different Co-ordinate Bench of this Court. Learned APP for the State after going through the case diary submits that accusation of firing has been levelled against the petitioner and others.

Considering the nature of accusation and the report of the learned 15th Additional Sessions Judge, East Champaran, Motihari suggesting that three witnesses have already been examined and the trial is likely to be concluded within six months, this Court is not inclined to grant bail to the petitioner for the present.

Accordingly, the prayer for bail of the petitioner in Sessions Trial No. 677 of 2018 arising out of Nagar (East Champaran) P.S. Case No.544 of 2014, pending before the learned District and Sessions Judge-XV, East Champaran, Motihari is rejected.
