The petitioner apprehends arrest in connection with Rosera P.S. Case No. 205 of 2016 dated 29.07.2016 instituted under Sections 47A/54/57 of the Bihar Excise Act, 1915. After some arguments, learned counsel for the petitioner seeks permission to withdraw the application in order to surrender before the Court below and seek regular bail in view of the fact that he has no document to show that the motorcycle which was recovered had been sold by him to another person much prior to the date of occurrence.
Learned A.P.P. does not oppose.
In view of the aforesaid, the application stands
Patna High Court Cr.Misc. No.44954 of 2016 dt.18-10-2016 2/2 disposed off as withdrawn with liberty aforesaid. It goes without saying that in the event the petitioner surrenders before the Court below and seeks regular bail within six weeks from today, the same shall be considered on its own merits, in accordance with law, without being prejudiced by the present order.
