JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 2 17-02-2016 By way of the present application preferred under Section 482 of the Code of Criminal Procedure, the petitioner No. 1, Dheeraj Kumar, seeks modification in the cause title of the order dated 10.11.2015 passed in Cr. Misc. No. 51720 of 2015.

It is contended that the father's name of the petitioner is Arvind Singh, but due to inadvertence while filing Cr. Misc. No. 51720 of 2015, the father's name of the petitioner was not mentioned and the name of the petitioner was typed as Dheeraj Kumar @ Arvind Kumar. Since there was an

Patna High Court Cr.Misc. No.586 of 2016 (2) dt.17-02-2016 2 / 2 inadvertent error in the memo of application for bail, the cause title of the impugned order was also typed accordingly as Dheeraj Kumar @ Arvind Kumar.

It is further contended that because of the apparent typing error made by the petitioner, the petitioner could not surrender before the learned Chief Judicial Magistrate, Patna within the stipulated period fixed by the court vide order dated 10.11.2015.

Learned counsel for the State does not oppose the prayer for modification in the cause title of Cr. Misc. No. 51720 of 2015.

Regard being had to the submissions made hereinabove, in the cause title of the order dated 10.11.2015, name of the petitioner Dheeraj Kumar @ Arvind Kumar be read as Dheeraj Kumar, son of Arvind Singh. The time granted for appearance before the court in order to furnish bail bond is extended further by two weeks from today.

The application stands disposed of.
