Learned counsel for the petitioner is permitted to remove defect(s), as pointed out by the office, if any, within a period of four weeks from today.

This application for anticipatory bail arises out of Tatarpur P.S. Case No. 260 of 2018 for the offence punishable under Sections 386 & 307/34 of the Indian Penal Code and under Section 27 of the Arms Act.

The petitioner is accused in a case of demand of ransom and has serious criminal antecedents. In the opinion of this Court, the petitioner does not deserve for anticipatory bail. Accordingly, this bail application is dismissed. This case is of the year 2018 and it is surprising that the Police has not taken action against the accused persons.

If he does not surrender within a period of two weeks from today, the Senior Superintendent of Police, Bhagalpur will take all coercive steps available to him in law for putting the accused persons on trial. The Senior Superintendent of Police will also get the speedy trial of all the accused persons of this case and submit a status report in this Court within a period of four weeks from today. The District & Sessions Judge, Bhagalpur, will also take all steps for speedy trial of the accused persons of this case. Put up this case on 05.05.2022 for consideration of the status report to be filed by the Senior Superintendent of Police, Bhagalpur.

Office is directed to send a copy of this order to the Senior Superintendent of Police, Bhagalpur and the District & Sessions Judge, Bhagalpur forthwith.

Sri Jharkhandi Upadhyay, learned APP for the State shall also communicate this order to the Senior Superintendent of Police, Bhagalpur immediately.
