The petitioner seeks bail in a case registered for the offence punishable under Sections 325, 326, 307, 342, 504, 506/34 of the Indian Penal Code.
Earlier, prayer for bail of the petitioner was rejected vide order dated 28.10.2021 passed in Cr. Misc. No. 29957 of 2021.
Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. He submits that there is specific allegation against accused Monu Kumar who assaulted the deceased with knife and petitioner was only caught hold of the deceased. He submits that the similarly situated co-accused has already been granted bail by a coordinate Bench of this Court. He submits that the petitioner has no criminal antecedent as stated in para 3 of the
Patna High Court CR. MISC. No.28738 of 2022(3) dt.10-08-2022 2/2 bail application and he is languishing in judicial custody since 22.11.2020.
Considering the facts and circumstance of the case and the fact that there is no specific allegation against the petitioner, let the above named petitioner, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Bahadurpur P.S. Case No. 525 of 2020.
