JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 02/ 06.04.2018 Heard learned counsel for the petitioners as well as learned Addl. Public Prosecutor for the State. Petitioners apprehend their arrest in connection with Morkahi P. S. case no. 148/2017 registered under sections 341, 323, 504, 448, 506, 427, 380, 354B/34 of the IPC.
Petitioners, allegedly having entered into the house of the informant, committed theft and made attempt to outrage her modesty.
Written report goes to show that the alleged occurrence took place on 14.9.2017 whereas written report
Patna High Court Cr.Misc. No.14276 of 2018 (2) dt.06-04-2018 was given on 22.9.2017 and no sufficient explanation regarding the aforesaid delay has been given. Moreover, the impugned order goes to show that there was serious land dispute between the parties and proceedings under sections 107 and 144 Cr.P.C were going on.
Considering the aforesaid facts and circumstances as well as submissions of the parties and also taking note of the fact that the petitioners do not have any criminal antecedent, it is ordered that in the event of arrest/ surrender within four weeks from the date of receipt of this order to the concerned court, let the petitioners be released on bail on furnishing bail bonds of Rs 10,000/- each with two sureties of the like amount each to the satisfaction of the Sub divisional Judicial Magistrate, Khagaria in Morkahi P. S. case no. 148/2017 subject to condition as laid down under section 438(2) of the Cr.P.C.
