JUSTICE MOHIT KUMAR SHAH ORAL ORDER 07-10-2021 The present writ petition has been filed seeking quashing of the order dated 7.6.2021 passed by the SubDivisional Officer, Benipur, Darbhanga whereby and where under the P.D.S. license of the petitioner bearing License no. 15 of 2018 has been cancelled.

At the outset, the learned counsel for the petitioner seeks liberty on behalf of the petitioner to prefer an appeal under Section 32 (iii) of the Bihar Targeted (Control) Order, 2016 (hereinafter referred to as "the Order, 2016") before the appellate authority, however, he submits that a stipulated time be fixed for disposal of the case. Having regard to the facts and circumstances of the case as also considering the submissions made by the Ld. Counsel for the petitioner, the present writ petition stands disposed of with liberty to the petitioner to approach the appellate authority by filing appropriate appeal against the aforesaid order dated 7.6.2021 and in case such an appeal is filed within a period of four weeks from today, the appellate authority shall consider the same on merits and dispose it off, in accordance with law, by a reasoned and a speaking order within a period of eight weeks, thereafter.
