Petitioner apprehends his arrest in connection with Jehanabad P.S.Case No. 721 of 2017 registered for the offences punishable under Sections 419 and 420 of the Indian Penal Code. Allegation against the petitioner is that he allowed another person to appear in the Constable Recruitment Examination and he was caught at the examination hall. Submission of learned counsel for the petitioner is that FIR does not show that admit card or any paper has been recovered from the possession of the petitioner and he has falsely been implicated in this case.

Having heard both sides and in the facts and
Patna High Court Cr.Misc. No.13438 of 2018 (2) dt.06-04-2018 2/2 circumstances, let the petitioner, above named, surrender within a period of four weeks and on his so surrendering he shall be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-cumSub-Judge-I, Jehanabad, in connection with Jehanabad P.S.Case No. 721 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further conditions that (1) one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned and (2) petitioner will co-operate in investigation and will appear before the Investigating Officer as and when required, except on genuine ground, failing which the prosecution is given liberty to move for cancellation of his bail bond.
