The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 324, 307 and 302 of the Indian Penal Code. The specific allegation of commission of assault on Bipin Yadav as a result whereof Bipin died is against co-accused, Ashok Yadav, Manoj Yadav and Saroj Yadav. There is no specific allegation against the petitioner Dev Kumar Yadav. Similarly situated co-accused Bhubneshwari Yadav and others have already been allowed anticipatory bail by a Co-ordinate Bench of this Court in Cr. Misc. No. 21177 of 2015 on 30.07.2015 In the circumstances, let the petitioner, above named, in the event of his arrest or surrender before the Court below

Patna High Court Cr.Misc. No.53123 of 2016 (2) dt.08-12-2016 within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saharsa/Successor Court in connection with Saharsa Police Station Case No. 122 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
