The petitioner apprehends his arrest in a case registered for the offences punishable under Section 414 of the Indian Penal Code read with Section 30(a) of the Bihar Excise Act.

Learned counsel for the petitioner submits that the petitioner is a person with clean antecedent and the informant alleges that on 09.01.2021, during the course of patrolling he received confidential information that two persons were selling liquor on a scooty, accordingly the police reached the place of occurrence when both the persons sitting on the scooty fled on seeing the police. It is next alleged that local shopkeepers

Patna High Court CR. MISC. No.37167 of 2021(2) dt.14-06-2022 2/2 disclosed the name of the accused persons and on search of the said scooty 900 ml of liquor was recovered.

Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case, he is neither the owner nor the driver of the scooty and his name transpired at the behest of shopkeeper for reasons best known to him.

Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 5,000/- (Rupees Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Kudhani (Turki O.P.) P.S. Case No. 24 of 2021 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
