The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 30(a) and 32(3) of the Bihar Excise Act.

Learned counsel for the petitioner submits that the petitioner is a person with clean antecedent and the informant alleges that during the course of checking of vehicle two persons were seen coming on a vehicle and on seeing the police they tried to flee and managed to escape from the place of occurrence. It is next alleged that on search of the motorcycle 30 litres of liquor was recovered.

Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case, he had

Patna High Court CR. MISC. No.37146 of 2021(2) dt.14-06-2022 2/2 lent his motorcycle to his neighbour who misused the same and the petitioner was completely unaware of his misdeeds. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 5,000/- (Rupees Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Muffasil P.S. Case No. 141 of 2020 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
