The petitioner prays for anticipatory bail in connection with Narari Kala Khurd P.S. Case No. 16 of 2016 instituted for the offences punishable under Sections 147, 148, 149, 228, 323, 324, 337, 338, 307, 395, 427, 504, 506, 120B of the Indian Penal Code, Section 25(1-b)A, 26, 35 of the Arms Act and Section 3 of the Damage of Public Property Act. It has been submitted on behalf of the petitioner that the complexity of the petitioner transpires from the video footage and no specific overt act has been alleged against the petitioner. It has also been submitted that co-accused having similar allegation have already been granted anticipatory bail by
Patna High Court Cr.Misc. No.45448 of 2016 (2) dt.15-12-2016 2/2 another co-ordinate Bench of this Court in Criminal Miscellaneous Nos. 46478 of 2016 and 46563 of 2016. Heard the learned APP also.
Having heard both sides, in view of the fact that coaccused having similar allegation have already been granted anticipatory bail by another co-ordinate Bench of this Court, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of six weeks, be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Aurangabad (Bihar) in connection with Narari Kala Khurd P.S. Case No. 16 of 2016, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure. This is subject to the condition that the petitioner shall present his before the police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to the cancelled.
