The petitioner seeks anticipatory bail in connection with Arwal PS case no. 196 of 2017 registered for the offences punishable under Sections 147, 148, 149, 341, 323, 336, 379, 295A and 153-A of the Indian Penal Code. In the present case four cases are stated to have been lodged on account of communal disharmony and the impending dispute and assault amongst the members of the two communities. Two cases are said to have been lodged by the members of the two communities against each other and two cases are said to have been filed by the police. The allegation is regarding the petitioner and other accused persons having assaulted the members of the

No.10545 of 2018 (2) dt.26-02-2018 2/2 other community and also engaging in loot etc. The learned counsel submits that on account of communal disharmony, the alleged incident had taken place, however, similarly situated coaccused persons have already been granted anticipatory bail. Having regard to the facts and circumstances of the case, in the event of arrest or surrender before the concerned court within a period of six weeks from the date of receipt/production of a copy of the present order, the petitioner above named is directed to be released on anticipatory bail on furnishing bonds of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM, Arwal in connection with Arwal PS case no. 196 of 2017, subject to the conditions laid down under Section 438(2) of Code of Criminal Procedure.
