1. Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. The petitioner apprehends his arrest in connection with Dinara (Bhanas) P.S. Case No. 360 of 2022 registered for the offences punishable under Sections 341, 323, 307, 504 and 34 of the Indian Penal Code.
3. Learned counsel for the petitioner submits that the petitioner is a person with clean antecedent.
4. The informant alleges that on account of dispute relating to cutting of mud from the land, an altercation took place in which Jagnarayan started abusing the informant and slapped him, thereafter, Munna, Santosh Ram (petitioner) and Sunil Ram assaulted the informant and his
Patna High Court CR. MISC. No.30085 of 2023(2) dt.26-07-2023 2/3 father with lathi and danda, it is next alleged that Munna assaulted the father of the informant with an iron rod causing injury on his head and petitioner assaulted Sushil Kumar with lathi on his leg and waist.

Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case, it is next submitted that the injury suffered by the father of the informant is simple in nature, though, it is alleged that he was assaulted by Munna and as far as allegation against the petitioner is concerned, he is alleged to have assaulted Sushil with lathi causing injury on his leg and waist, but then the assault is not on vital part of the body.
6. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.
7. Considering the submissions made by the learned counsel for the petitioner, the petitioner abovenamed, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of

No.30085 of 2023(2) dt.26-07-2023 3/3 the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Dinara (Bhanas) P.S. Case No. 360 of 2022 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
