JUSTICE CHANDRA PRAKASH SINGH ORAL ORDER 21-09-2022 Learned counsel for the petitioner is permitted to remove defect (s), as pointed out by the office, if any, within a period of four weeks on resumption of physical mode. Heard learned counsel for the petitioner and learned A.P.P for the State.

The petitioner has preferred this application for grant of regular bail in a case registered under sections 341, 323, 324, 325, 307, 379, 504 and 506 read with 34 of the Indian Penal Code.

As per the prosecution case, the petitioner and coaccused person in connivance with each other came to the shop of the informant and stated abusing him. On being protested, the co-accused Chandresh Singh @ Pappu Singh started inflicting

Patna High Court CR. MISC. No.28341 of 2022(2) dt.21-09-2022 2/3 blows of knife on the informant's brother indiscriminately with intent to kill which hit nose and hand of the informant's brother. The co-accused also stabbed in his stomach thrice. The petitioner further alleged that person assaulted the informant's brother with iron rod and snatched Rs. 25,000 from the galla of his shop.

Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The petitioner is the landlord and the informant's brother is tenant. There is dispute between the petitioner and the informant's brother is on account of dues rent. The informant's brother has sustained six multiple injuries caused by sharp edged weapon. It is further submitted that there is no injury of iron rod on the brother of the informant. Nothing has been recovered from the conscious possession of the petitioner. The petitioner is also accused in one more case as stated in para 3 of the bail petition. The petitioner is in custody since 20.02.2022. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty

Patna High Court CR. MISC. No.28341 of 2022(2) dt.21-09-2022 3/3 Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Saran in connection with Marhaurah P.S. Case No. 103 of 2022.

The application stands allowed.
