The petitioner prays for anticipatory bail in connection with Jokihat (Mahalgaon) PS case no. 91 of 2016 registered for the offence punishable under section 379 and other sections of Indian Penal Code.
It is submitted on behalf of petitioner that there is case and counter case pending between the parties and this case is lodged due to previous enmity. It is further submitted that the injury found on the person of the informant is said to be simple and he has annexed injury report with this application. Heard learned A.P.P. also.
Having heard both sides. It appears that that there
Patna High Court Cr.Misc. No.552 of 2017 (2) dt.18-01-2017 2/2 is case and counter case pending between the parties and injury report shows that injury received by the informant is simple in nature which appears from annexure-3 series. As such, the bail application of petitioner is allowed and he is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/-(Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of Sub-Divisional Judicial Magistrate, Araria in connection with Jokihat (Mahalgaon) PS case no. 91 of 2016 subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure with further condition that he will cooperate in the disposal of the case and make himself available as and when required.
