This application is for grant of anticipatory bail in connection with Bhorey P.S.Cae No.97 of 2016 for the offence under Sections 272, 273 and 420 of the Indian Penal Code and Section 47(a)(g) of New Excise (Amendment) Act, 2016. It is submitted on behalf of the petitioner that the petitioner has nowhere concern with respect to alleged recovery of foreign liquor. As a matter of fact that a Car met with an accident and in the said Car foreign-made liquor has been recovered and the petitioner is not owner of the said Car, however, the petitioner has been implicated in this case, at the
Patna High Court Cr.Misc. No.558 of 2017 (2) dt.17-01-2017 instance of the Chaukidar.
Heard learned A.P.P. also.
Having heard both sides. In view of the facts as stated above and also as there is no recovery of foreign-made liquor from the possession of the petitioner, let the petitioner, above named, in the event of arrest or surrender before the court below within a period of six weeks, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of A.C.J.M.-XII, Gopalganj in connection with Bhorey P.S.Case No.97 of 2016, subject to conditions as laid down under Section 438 (2) of the Code of Criminal Procedure with a condition that he will co-operate in the trial and he will make available himself as and when required.
