Mr. Smt. Anusuiya Jaiswal ====================================================== CORAM: HONOURABLE MR. JUSTICE MOHIT KUMAR SHAH ORAL ORDER 02-04-2018 Heard the learned counsel for the petitioner and the learned A.P.P. for the State.

This is an application for grant of anticipatory bail in connection with Kajra P.S. Case No. 83 of 2017 registered for the offence punishable under Sections 341, 323, 307, 34 of the Indian Penal Code and Section 27 of the Arms Act. The allegation is regarding the accused persons including the petitioner herein engaging in altercation with the prosecution side resulting in both the sides receiving injuries. The learned Senior Counsel for the petitioner submits that as far as the present petitioner is concerned, there is no allegation of any assault resulting in any sort of injury on the person of the informant, though, there is direct allegation against the other accused persons regarding firing from the pistol or assaulting the prosecution side. One of the accused persons of the present case had filed FIR on the same day, the P.S. case number whereof is earlier to the present case. It is also the contention of the learned Senior Counsel for the petitioner that the accused side has received grievous injuries while the prosecution side has received simple injury. It is further submitted that the petitioner is having a clean antecedent.

Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner above named, in the event of his arrest or surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, on anticipatory bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. III, Lakhisarai in connection with Kajra P.S. Case No. 83 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Mohit Kumar Shah, J) ajay gupta/- U T
