The petitioner has been in custody since 24.03.2020 in connection with Kawakole P.S. Case No. 93/2019 registered for the offences punishable under Sections 366(A) of the Indian Penal Code.

As per the prosecution case, the petitioner is alleged to have kidnapped the daughter of the informant. It is submitted on behalf of the petitioner that petitioner is innocent and that petitioner is not Amit Pandit who is alleged to have kidnapped the daughter of the informant. Amit Kumar Pandit is someone else and this petitioner claims to be Ramanand Kumar son of Devendra Pandit whereas as per the FIR, Amit Kumar Pandit is son of Deo Pandit.

Patna High Court CR. MISC. No.24223 of 2020(4) dt.07-12-2020 2/2 Learned counsel for the State opposes the bail application of the petitioner and has submitted that prosecution case is duly supported by the statement recorded under 164 of the Cr. P.C. by the victim girl and there is specific allegation that the petitioner has kidnapped her and raped her. During the course of investigation, it has come in paragraph No. 52 of the case diary that this petitioner is also known as Amit Kumar Pandit.

Considering the aforesaid facts and circumstances, I am not inclined to grant bail to this petitioner. It is, accordingly, rejected.
