JUSTICE VINOD KUMAR SINHA ORAL ORDER 24-08-2017 The appellant seeks pre arrest bail in connection with Rupauli (Mohanpur) P.S. Case No. 56 of 2017, registered for offences punishable under Sections 147, 148, 149, 323, 341, 302 and 326 of Indian Penal Code and section 3(i)(iii) and (x) of SC/ST Act.

Allegation against the appellant is of assaulting the mother-in-law of the informant and also of setting her on fire. It has been submitted on behalf of the appellant that he has falsely been implicated in this case and he was not present at the place of occurrence at the alleged date of occurrence rather he was in Jalandhar.

Let appellant surrender before the special court and make prayer for regular bail and if any such application is filed, the special court after considering the above submission of learned counsel for the appellant and also other materials available on record, shall pass an appropriate order, preferably on the same day, without being prejudiced by the order of this Court.
