====================================================== CORAM: HONOURABLE MR. JUSTICE RAMESH CHAND MALVIYA ORAL ORDER 15-07-2026 Heard learned counsel for the petitioner, learned counsel for the Informant, learned APP for the State and perused the case diary.

2. The petitioner is in custody in a case registered for the offence punishable under Sections 87 and 123(3) of the BNS, 2023 and Sections 8 and 12 of the POCSO Act.

As per allegation in the FIR, the daughter of the informant, aged about 15 years went to purchase some materials but she did not return to her house, the informant searched diligently but could not find any trace of her. It is further alleged that the petitioner is seen as a criminal in the society and petitioner is the driver who kidnapped the daughter of the

No.29309 of 2026(3) dt.15-07-2026 2/3 informant while she was returning home from Sipara market at around 6 P.M, forcibly making her sit in a Maruti Swift car bearing registration no. BR01DY-6395 and petitioner already had taken photo of the daughter of the informant in his mobile and demanded that only if the informant's daughter perform marriage with the petitioner, otherwise petitioner will make the photo of the informant's daughter viral.

4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case due to suspicion. Petitioner is in custody since 11.10.2025.

5. Learned APP for the State as well as the Informant opposes the prayer for bail of this petitioner and submits that the petitioner is kidnapped the minor daughter of the informant. Learned counsel for the Informant produce some photo copy of the case diary as well as trial court order-sheet and submits that petitioner has got total four criminal antecedents but in para-3 of the bail petition, he has mentioned only one criminal antecedent, so it is a case of concealment of facts by the petitioner.

6. On perusal of the first information report, case diary, the statement of the victim girl recorded under Section 183 of the BNSS and impugned order dated 02.04.2026, it appears that the petitioner has done cruel and brutal acts upon

No.29309 of 2026(3) dt.15-07-2026 3/3 the minor daughter of the informant and he keeps his leg on victim's mouth, was threatening against her and thereafter victim just started weeping very emotionally in the Court after seeing the video submitted in pen-drive in the court room. From perusal of the statement of the victim girl recorded under Section 180 of the BNS before the police as well as the statement under Section 183 of the BNSS, it appears that she has specifically stated that petitioner by making her vulgar and obscene videos used to blackmail her since long and call her in hotel from where the victim finally recovered by the police, considering which, I am not inclined to grant regular bail to the petitioner.

7. Accordingly, the prayer for regular bail of the petitioner is hereby rejected.
