The petitioners apprehend their arrest in connection with Asthawan P.S. Case No. 34 of 2017 registered under Sections 341, 323, 325, 354B and 504/34 of the Indian Penal Code. Considering the facts and circumstances of the case and the rival submissions of the parties, since admittedly the petitioners were on Police Bail and have not misused the privilege of bail, it is directed that if the petitioners appear in the Court below within a period of four weeks from today and makes a prayer for bail, the same shall be considered and disposed of on its
Patna High Court Cr.Misc. No.40149 of 2017 (2) dt.22-09-2017 2/2 own merits in the light of the observations made in the case of Mahendra Prasad Singh Vs. State of Bihar, reported in 2004(3) PLJR, 491.
With the above direction/observation, this application is disposed of.
