JUSTICE ASHWANI KUMAR SINGH ORAL JUDGMENT Date: 20-12-2016 It is submitted by the petitioner that during pendency of the writ petition apart from the amount of CPF and the difference of arrears of salary for the period April, 1997 to June, 2001 raised due to fixation of revised 4th and 5th pay revision, all other postretiral dues as well as arrears of salary has been paid to the petitioner.

2. Mr. Nikesh Kumar, learned counsel for the Zila

Patna High Court CWJC No.14198 of 2012 dt.20-12-2016 2 / 2 Parishad, Bhojpur fairly concedes that in regard to Contributory Provident Fund, Rs. 5,51,779/- and in regard to difference of arrears of salary Rs.70,780/- is payable to the petitioner, but the said amount could not be paid so far due to paucity of fund. He submits that efforts are being taken to pay the aforesaid amount to the petitioner and the same would certainly be paid within three months.

3. Regard being had to the submission made by the learned counsel for the parties, I direct the respondents to pay the admitted dues mentioned above to the petitioner within a period of three months from today, failing which the respondents will be liable to pay interest at the rate of 8% per annum from the date the amount became due till the date of actual payment.
