Petitioner is apprehending arrest in connection with Gopalpur P.S. Case No.143 of 2017 for the offence under section 341, 323, 324, 307, 504, 506/34 of the Indian Penal Code.
In this case diary was called for.
Mr. Kanhaiya Prasad Singh, learned Sr. Advocate appearing on behalf of the petitioner submits that from the Fardbeyan itself it is evident that this petitioner has not given any blow causing injury which led to the death of the deceased. The specific allegation of assault by spade is against one Shaukat Ali .
Patna High Court Cr.Misc. No.5690 of 2018(3) dt.27-02-2018 2/2 He submits that the petitioner has clean antecedent as per statement on affidavit in para-3.
Learned counsel for the State on the basis of case diary admits that there is no specific overt act which led to any injury which is cause of the death of the deceased. In view of the above, let the petitioner, named above, be released on bail in the event of arrest/surrender before the court below within a period of one month from the date of receipt/production of a copy of this order furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of A.C.J.M.XI, Gopalganj, in connection with Gopalpur P.S. Case No. 143 of 2017 subject to the condition as laid down under section 438(2) of the Cr.P.C. (Anil Kumar Upadhyay, J) Ravi/- U
