The petitioner apprehends his arrest in connection with Nawada Town (Nagar) P.S. Case no. 342 of 2016, registered under Sections 304B of the Indian Penal Code.
The prosecution case is that on 18.06.2016, the informant received information that her daughter Ishrat Parveen was set on fire by her in-laws. Then he reached at her Sasural, where he learnt that her daughter has been taken to Sadar Hospital, Nawada from where she has been referred to Patna.
Learned counsel for the petitioner submits that, in fact, the daughter of informant sustained burn injury at the time of cooking meal and she was rushed for treatment at Sadar Hospital, Nawada from where she was referred to Patna, but she died in the way. Further submission is that
Patna High Court Cr.Misc. No.38932 of 2016 (2) dt.06-10-2016 2/2 information, with regard to incident, has also been given to the informant, but due to ulterior motive petitioner has falsely been implicated in this case.
Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Nawada in connection with Nawada Town (Nagar) P.S. Case No. 342 of 2016, subject to the condition as laid down under Section 438 (2) of the Cr.P.C. (Rajendra Kumar Mishra, J) manish/- U T
