Mr.Rajendra Singh, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE SANDEEP KUMAR ORAL ORDER 24-05-2023 Heard learned counsel for the petitioner and State. The petitioner is in custody in connection with Wazirganj P.S. Case No. 309 of 2022 for the offence under Sections 379, 411, 413, 414, 34 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner has got one criminal antecedent and he is in custody since 03.02.2023.

It is alleged that police party raided and recovered stolen motorcycle from the possession of accused persons, namely, Vikash Kumar and Prince Kumar. It is further alleged that petitioner is involved in theft of motorcycle. There is no recovery of motorcycle in question from possession of the petitioner.

Considering the fact there is no recovery from his possession,

No.28665 of 2023(2) dt.24-05-2023 2/2 the petitioner, named above, is directed to be released on bail after framing of charge on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M-1st, Gaya in connection with Wazirganj P.S. Case No. 309 of 2022. Trial Court is directed to expedite the trial. The petitioner will visit Wazirganj Police Station on the first Sunday of each month. Any default in appearance at the Police Station would be result in cancellation of bail bond of the petitioner.
