ANJANA MISHRA ORAL ORDER 11-01-2016 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is apprehending her arrest in connection with Barbigha P.S. Case No.324 of 2015 for allegedly having committed the offence under Sections 414, 420, 406 of the Indian Penal Code and Section 7 of the Essential Commodities Act.

The petitioner is the owner of the vehicle in question which had been let out to one Pankaj Kumar Pankaj. The said vehicle was apprehended by the police along with the foodgrains under suspicious circumstances. Learned counsel for the petitioner submits that so far as this petitioner is concerned, she is the owner of the vehicle

Patna High Court Cr.Misc. No.57511 of 2015 (2) dt.11-01-2016 2/2 and since the said vehicle had been taken on hire by one Pankaj Kumar Pankaj, no criminal liability can be attached to the petitioner.

Considering the aforementioned facts and circumstances and that the petitioner has got no criminal antecedents, let the petitioner, above named, in the event of her arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Sheikhpura, in connection with Barbigha P.S. Case No.324 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Anjana Mishra, J) PNM U T
