2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 80, 85, 115(2), 352, 351(30 (5) of the BNS and Section 3⁄4 of the Dowry Prohibition Act.

3. The case of the prosecution is that the daughter of the informant, namely, Sneha Kumari was married to Satyam Kumar on 11.05.2023 according to Hindu rituals. It is further alleged that her in-laws subjected her to cruelty for nonfulfillment of demand of dowry and even she was not allowed to

It is further alleged that on 27.08.2024, informant received an information on phone that his daughter is ill and she is under treatment at Pawapuri Hospital, Nalanda. On this information, informant went there and from there she was referred to PMCH, Patna but on the way, she died. Hence, the present FIR.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in connection with the present case. It is further submitted that the real fact is that the deceased was pregnant and she died on account of complexity in pregnancy for which he has also annexed a post-mortem report which goes to show that the reason of death is due to Pervaginal bleeding. Moreover, the petitioner is a husband and is languishing in judicial custody since 19.10.2024 having no criminal antecedent.

5. Learned APP appearing for the state has opposed the prayer of regular bail.

6. Considering the aforesaid facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Thali P.S. Case No. 217 of 2024 on furnishing bail bond of Rs.10,000/- (ten thousand) with two
