JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 02/ 06.04.2018 Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Barauni P. S. case no. 377/2017 registered under sections 25(I-B), a, 26/35 of the Arms Act.

One co-accused Rakesh Raman was caught and seven live cartridges were recovered from his conscious possession. It is alleged that the petitioner was pillion rider of the motorcycle of the aforesaid apprehended accused Rakesh Raman who disclosed the name of the petitioner before police. There is nothing in the FIR that at the time of alleged occurrence, petitioner was also carrying any firearm or was aware about live cartridges which were recovered

Considering the aforesaid facts and circumstances as well as submissions of the parties, it is ordered that in the event of arrest/ surrender within four weeks from the date of receipt of this order to the concerned court, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Begusarai in Barauni P. S. case no. 377/2017 subject to condition as laid down under section 438(2) of the Cr.P.C.
