The petitioner apprehends his arrest in connection with Uchkagaon P.S. Case No. 145 of 2016 registered under Sections 341, 323, 324, 307, 379 and 504/34 of the Indian Penal Code. The accusation is that, on 10.07.2016, at 11.30 P.M., informant was returning to his house on motorcycle. When he reached near bridge at Brahamine Bargachhaiya then his villagers Mahant Singh asked on the point of Pistol to stop the vehicle. When he stopped his motorcycle villager Sarda Nand Singh, Kamlesh and petitioner surrounded him and Mahant Singh asked him to give the money and other articles. When the informant made protest then this petitioner gave sword blow at his right palm. At that time, Sarda Nand Singh Akhilelsh Singh also caused
Patna High Court Cr.Misc. No.43625 of 2016 (2) dt.17-10-2016 injury through Danda. In the meantime, Sarda Nand Singh took cash of Rs.20,000/- and Kamlesh Singh snatched gold chain. Learned counsel for the petitioner submits that admittedly the petitioner and the informant are co-villagers and due to dispute occurrence took place, in which, petitioner also sustained injury, regarding which, Uchkagaon P.S. Case No. 147 of 2016 is instituted on the basis of written report of petitioner. While five injuries were said to be found on the person of the informant but all injuries are simple in nature. Considering the aforesaid submissions, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs.
10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Gopalganj, in connection with Uchkagaon P.S. Case No. 145 of 2016, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
