The petitioner seeks pre-arrest bail in connection with Turkaulia P.S. Case No.738 of 2014 corresponding to G.R. Case No.5622 of 2015 registered under Sections 272 and 273 of the Indian Penal Code as well as Section 47A of the Excise Act. It has been contended by the learned counsel for the petitioner that the petitioner has got no criminal antecedent and the seizure list would make it evident that recovery of the incriminating articles was made from the field of one Amerika Singh.

Regard being had to the facts and circumstances of the

Patna High Court Cr.Misc. No.214 of 2016 (2) dt.11-01-2016 2/2 case, in the event of arrest or surrender in the court below within six weeks from today, the above named petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran, Motihari in connection with Turkaulia P.S. Case No.738 of 2015 corresponding to G.R. Case No.5622 of 2015 subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
