2. Petitioner apprehends arrest in a case registered for the offence punishable under sections 137(2), 140(3), 352, 351(2)(3), 3(5) of the Bharatiya Nyaya Sanhita, 2023.
3. As per the prosecution case, all the FIR named accused persons including this petitioner kidnapped wife of informant when she had gone to attend call of nature.
4. Learned counsel appearing for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. As a matter of fact, petitioner and wife of informant were in love and the present case is not of abduction. F.I.R. has been lodged after inordinate delay of four
Patna High Court CR. MISC. No.26976 of 2025(4) dt.11-08-2025 2/2 days without any explanation which renders the entire prosecution case doubtful. Petitioner claims clean antecedent.
5. Learned counsel for the State and the informant opposes the prayer for bail. They submit that the victim, in her statement recorded under section 164 of the Code of Criminal Procedure, has supported the prosecution case.
6. Considering the nature and gravity of allegation and the aforesaid statement of the victim, prayer for bail of the petitioner is rejected.
