The petitioner seeks bail in Rajpur P.S. Case No. 54 of 2018, instituted for the offence under Section(s) 302, 201 and 34 of Indian Penal Code.

It is alleged in the written report that nephew (Bhagina) of the informant namely, Munna Kumar, who is resident of village Amarpur left house on 4.11.2018 and did not return. The informant started making search. His dead body was found on 6.11.2018 in a pond situated near School Compound. Counsel for the petitioner submits that petitioner is not named in the written report. The name of petitioner has come during investigation in the statement of witnesses. Mere suspicion has been raised against the petitioner in the case diary

Patna High Court CR. MISC. No.27246 of 2019(4) dt.12-07-2019 2/2 by the witnesses. The other co-accused have already been granted bail by this Court and coordinate Bench of this Court vide orders dated 16.5.2019 and 23.5.2019 passed in Cr. Misc. 32595 of 2019 and 34088 of 2019 respectively. Petitioner is in custody since 25.1.2019 having clean antecedent.

Counsel for the informant has appeared and opposed the prayer for bail Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Vikramganj, Distt. Rohtas, in connection with Rajpur P.S. Case No. 54 of 2018, subject to the condition that both the bailors will be close relatives of the petitioner.
