JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 17-10-2017 Heard learned counsel for the petitioner and learned APP for the State.

Petitioner is seeking anticipatory bail in connection with Sakra P.S. Case No.163 of 2017 registered for offences punishable under Sections 25(1-B)26/35/25(1-AA)25(1-AAA) of the Arms Act.

Learned counsel for the petitioner submits that the petitioner has got no criminal history, but because of some enmity name of the petitioner has been brought in the confessional statement allegedly recorded by the police from the apprehended accused namely Dharmendra Kumar. No recovery has been made from the petitioner and only on the basis of that extra-judicial confessional statement the petitioner is likely to be arrested by the

Patna High Court Cr.Misc. No.50649 of 2017 (2) dt.17-10-2017 police.

On the other hand, learned APP for the State opposed the prayer for anticipatory bail.

Considering the fact that the petitioner has no criminal history and his name is said to have transpired in the confessional statement, in case of arrest or surrender of the petitioner within a period of four weeks from today, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the of the like amount each to the satisfaction of the learned SubJudge-13th-cum-A.C.J.M., Muzaffarpur in connection with Sakra P.S. Case No.163 of 2017, subject to the condition that the petitioner shall cooperate in the investigation and shall immediately report to the investigating officer latest within a period of two weeks from today and shall continue to do so if the investigating officer so desires. The petitioner shall also abide by the conditions mentioned in Section 438(2) Cr.P.C. (Rajeev Ranjan Prasad, J) Arvind/- U T
