This application has been filed in connection with Kurtha P.S.Case No.89 of 2016 for the offence under Sections 147, 148, 149, 341, 323, 307, 379, 324, 504 and 506 of the Indian Penal Code.

It is submitted on behalf of the petitioners that though there are allegation against both the petitioners of assault but from the case diary, which has been called for, it appears that there is a dispute between the parties with respect to "Dalan" and the petitioners have also filed a complaint case against the informant and others.

Heard learned A.P.P. also.

Patna High Court Cr.Misc. No.54564 of 2016 (3) dt.30-01-2017 2/2 Having heard both sides. As there are allegation of assault against the petitioners, I am not inclined to grant anticipatory bail to the petitioners, however, let the petitioners surrender before the court below and the court below will consider this aspect of the matter that there is a dispute between the parties from before and the injuries have been found on the persons of the informant and others and will dispose of the application of the petitioners as soon as possible.

With the aforesaid observation, this application is disposed of.
