JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 27-01-2017 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners apprehend their arrest in connection with A.P.M. P.S. Case No. 183 of 2012, registered under Section 273 of the Indian Penal Code and Section 47(a)(f) of the Excise Act, pending in the court of Chief Judicial Magistrate, Darbhanga. The accusation is that in course of raid of the house of the petitioners, three plastic cane, two aluminum Dekchi containing 25 litres 'Chhoa' to the house of petitioner no.1, seven plastic cane containing 30 litres of 'Chhoa' and two aluminum Dekchi containing three litres of country made liquor and the apparatus for preparing the liquors to the house of petitioner no. 2,

No.758 of 2017 (2) dt.27-01-2017 five plastic cane containing 30 litres of Chhoa, one aluminum Dekchi and three earthen pot to the house of petitioner no. 3 and six plastic cane containing 30 litres of Chhoa, two aluminum pot and one earthen pot to the house of petitioner no. 4 were recovered.

Having considered the facts and circumstances of the case and the nature of allegation against the petitioners, I am not inclined to grant anticipatory bail to the petitioners Accordingly, his prayer for grant of anticipatory bail stands rejected. The petitioners are directed to surrender before the trial court within four weeks and pray for regular bail, which would be considered by the trial court in accordance with law without being prejudiced by the order of this Court.
