JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 14-07-2015 Heard learned counsel for the petitioners and the respondents.
The writ application has been filed in the year, 2012. The petitioners seek quashing of the letter dated 12.06.2012 passed by the Deputy Development Commissionercum-Chief Executive Officer, Zila Parishad, Patna directing the Block Development Officer, Dhanarua to recover the money from the petitioners for having spent the money allotted to them under
Patna High Court CWJC No.14673 of 2012 (2) dt.14-07-2015 2 / 2 13th Finance Commission on hand pump and other items and not on Anganbari Centers.
A counter affidavit has been filed on behalf of respondent no.2 stating that in spite of Collector's instruction, the money was spent on other items, other than Anganbari Centres, for which the money was disbursed.
In my view, the petitioners should first approach the Deputy Development Commissioner-cum-Chief Executive Officer, Zila Parishad, Patna itself.
With the aforesaid observation, this writ application stands disposed of.
