2. Petitioner apprehends his arrest in connection with Pipra Kothi P.S. Case No. 295 of 2022 registered for the offences punishable under Sections 188, 272, 273, 414, 420/34 of the Indian Penal Code .

3. As per the prosecution case, 324 liters foreign liquor was recovered from three different vehicles and the accused petitioner fled away from the spot.

4. It is submitted that petitioner is innocent and has falsely been implicated in this case. The name of petitioner transpired in this case on the basis of confessional statement of co-accused Mukesh Kumar. Nothing has been recovered from conscious possession of this petitioner. The petitioner is neither

Patna High Court CR. MISC. No.30994 of 2024(2) dt.28-06-2024 2/2 driver nor owner of the seized vehicle in question. The petitioner has one criminal antecedent which is mentioned in para-3 of the petition.

Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed, in the event of his arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) each with two sureties of the like amount to the satisfaction of the learned Special Judge-I, East Champaran at Motihari in Pipra Kothi P.S. Case No. 295 of 2022, subject to condition as laid down under Section 438(2) of the Cr.P.C.
