Petitioner apprehends his arrest in a case filed under Sections 392/412 of the Indian Penal Code. It is contended on behalf of the petitioner that he was not apprehended on the spot and has been made accused only on the basis of suspicion that he was seen moving in a car ahead of the truck which was taken in possession by the miscreants who were apprehended from the spot. Petitioner has stated that he has a clean antecedent, however, he has also been implicated in another case for the same occurrence registered under Sections 25, 26 and 35 of the Arms Act against all the accused persons

Having regards to the facts and circumstances, in the event of arrest/surrender within a period of six weeks from today in Mohania P.S. Case No.288 of 2015, the above named petitioner, Mudrika Yadav @ Mudrika Singh shall be released on bail on furnishing bail bond of Rs.10,000( Ten Thousand Rupees) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Bhabua subject to the conditions as laid down under sub-section(2) of Section 438 of the Code of Criminal Procedure with a further condition that one of the bailors of the petitioner must be the close relative or his family member, who will file affidavit before the court below giving full genealogy showing his or her relationship with the petitioner. Further, if the petitioner, after his release in this case, is again found to be involved in criminal case of similar nature, the court concerned would be at liberty to take steps for cancellation of his bail bonds.
