====================================================== CORAM: HONOURABLE MR. JUSTICE MOHIT KUMAR SHAH ORAL ORDER 04-11-2020 Heard the learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Kathaiya P.S. Case No. 12 of 2020 for the offence registered under Section 392 of the Indian Penal Code.

The allegation is regarding two miscreants riding on a motorcycle having intercepted the informant and his nephew while they were travelling on their motorcycle and had then snatched the bag containing a sum of Rs. 80,000/- etc. whereafter the miscreants had fled away.

The learned counsel for the petitioner has submitted that the petitioner is innocent, he has been falsely implicated in the present case and is languishing in custody since 05.03.2020. Having regard to the facts and circumstances of the

Patna High Court CR. MISC. No.27853 of 2020(2) dt.04-11-2020 2/2 case, considering the submissions made by the learned counsel for the petitioner and taking into account the fact that no T.I. Parade has been held so as to connect the petitioner with the alleged crime and moreover the petitioner is languishing in custody since 05/03/2020, I deem it fit and proper to direct for release of the petitioner herein on regular bail. Accordingly, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-1st Class, Muzaffarpur in connection with Kathaiya P.S. Case No. 12 of 2020.
