The petitioner apprehends his arrest in connection with Kundwa Chainpur P.S. Case No. 160 of 2018 registered under Sections 272, 273, 414, 34 of the Indian Penal Code and 30(a) of the Bihar Prohibition and Excise Act, 2016. Learned counsel appearing on behalf of the petitioner submits that no any incriminating articles have been recovered from the possession of the petitioner. On perusal of Seizure List, it appears that 945 litres of Nepali Soufi has been recovered near the loading-unloading point (Dhala) of Railway. Further he submits that petitioner has no concern with the seized materials.

No.25024 of 2019(2) dt.18-04-2019 2/2 Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Special Judge, Excise, East Champaran, Motihari in connection with Kundwa Chainpur P.S. Case No. 160 of 2018, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
