JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 13-01-2017 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Barhara ( Raghubansh Nagar) Police Station Case No. 111 of 2016 registered for the offences punishable under Section 420, 406, 311 and 34 of the Indian Penal Code.

Petitioner is said to have assaulted one Sunil Kumar with bricks and also torn some documents of the concerned school but in course of investigation, even a chit of paper was not seized and the injury report of the aforesaid Sunil Kumar goes to show that only bruises were found on his person.

Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is

Patna High Court Cr.Misc. No.45043 of 2016 (3) dt.13-01-2017 2/2 allowed and it is ordered that petitioner, in the event of his arrest/surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs. 10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Purnea in Barhara ( Raghubansh Nagar) Police Station Case no. 111 of 2016, subject to condition as laid down under Section 438(2) of the Cr.P.C.
