The petitioners seek bail in connection with Magadh Medical P.S. Case No. 77 of 2020 for the offence under Sections 302/34 of the Indian Penal Code and Section 27 of the Arms Act.

Learned counsel appearing for the petitioner submits that the petitioners, who are of clean antecedent, are innocent and have not committed any offence. In fact, there is general and omnibus allegation against the petitioners and no specific allegation is attributed to them

Patna High Court CR. MISC. No.24956 of 2020(3) dt.04-12-2020 2/2 rather the specific allegation of assault is attributed to the co-accused Guddu Singh. Moreover, there is case and counter case between the parties. The petitioners are rotting in judicial custody since 23.05.2020.

Considering the facts and circumstances of the case, let the, above named, petitioner be released on bail on furnishing his personal bond to the satisfaction of learned A.C.J.M.-IV, Gaya in connection with Magadh Medical P.S. Case No. 77 of 2020.
