JUSTICE ARVIND SRIVASTAVA ORAL ORDER 17-02-2018 Heard learned counsels for the petitioner and the State. Petitioner apprehends arrest in connection with Bihta P.S. Case No. 790 of 2013 registered for the offence punishable under sections 307/34 of the Indian Penal Code. Learned counsel appearing for the petitioner submits that petitioner has been falsely implicated in this case. As a matter of fact neither any one has sustained any injury nor any fire arm has been recovered from this petitioner. Co-accused of this case had earlier filed a case against the present informant and others vide Annexure-2 and in retaliation the present false case has been lodged.

Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the petitioner, above named, in the event of arrest or surrender within a period

Patna High Court Cr.Misc. No.8151 of 2018(2) dt.17-02-2018 2/2 of four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, I, Danapur, Patna in connection with bihta P.S. Case No. 790 of 2013 subject to the conditions laid down under section 438(2) Cr.P.C.
