Petitioner is languishing in judicial custody since 02.02.2019 in connection with Mahila P.S. Case No. 04 of 2019 for offences punishable under Sections 498A, 323, 325, 307, 342 of the Indian Penal Code and Section 3⁄4 of the Immoral Traffic Act.

The prosecution case as lodged by the informant who is the wife of the petitioner is that while she was married to the petitioner on 12.04.2018 after a few days the petitioner started assaulting her and also wanted her to become a prostitute. It has been submitted by the learned counsel for the petitioner that he is innocent and has been falsely implicated in

Patna High Court CR. MISC. No.26222 of 2019(2) dt.13-05-2019 2/2 the aforesaid case. It is submitted in para-6 that the petitioner is ready to keep his wife, the informant, with full honour and dignity, if he is released on bail.

Considering the undertaking of the petitioner, let the petitioner above named be enlarged on bail on furnishing bail bond of Rs. 10,000 (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Purnea in connection with Mahila P.S. Case No. 04 of 2019, subject to the condition that the learned court below would take an undertaking on affidavit from the petitioner of keeping his wife with full dignity and honour and would not commit any assault on the informant in future, failing which the bail bonds of the petitioner is liable to be cancelled.
