2. Petitioners apprehends arrest in a case registered for the offence punishable under sections 341, 323, 324, 307, 504, 506, 120-B/34 of the Indian Penal Code.

3. On the alleged date and time of the occurrence while the informant was returning to his house all the F.I.R. named accused persons including these petitioners abused and

Patna High Court CR. MISC. No.29033 of 2023(2) dt.17-07-2023 2/3 assaulted the informant and petitioner No. 4 Uday Rai fired upon informant in which he sustained gun shot injury. It is further alleged that informants's nephew Rishikesh Kumar Singh had some altercation with petitioner No. 1 Ranjeet Rai, and other co-accused persons due to which they came to the house of the informant's house and opened fire and threatened to kill all the family members.

4. It is submitted that the petitioners are innocent and have falsely been implicated in this case. He further submits that there is no medical report on record to corroborate the allegation against these petitioners. Petitioner have not committed any offence as alleged in the prosecution .

5. Learned counsel for the State opposes the prayer for bail and submits that petitioners have been alleged to have fired on informant in which informant alongwith Ramesh Kumar @ Ram Babu Rai sustained firearm injury. It is next submitted that empty cartridge and a pellet has been recovered r by the police. Witnesses have also supported the prosecution case. Petitioner No. 1 has got 3 criminal antecedent, petitioner No. 2 has got one criminal antecedent and petitioner No. 3 has got 3 criminal antecedent of similar nature.
