Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 307, 504/34 of the Indian Penal Code.

It is alleged against the petitioner that the petitioner caught hold the husband of the informant, when Jatan Paswan assaulted with lathi. When the informant went to rescue, she was also assaulted.

It is submitted by the learned counsel for the petitioner that accusation of assault is not against the petitioner. Moreover, the informant has retracted from the initial version and filed a petition to that effect before learned court below.

The case was registered in 2008, this Court is not

Patna High Court Cr.Misc. No.57923 of 2015 (2) dt.04-01-2016 inclined to entertain this application.

However, since accusation of assault is not against the petitioner, let the learned court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Dumariya P.S. Case No. 28 of 2008, pending in the court of learned Sub-Divisional Judicial Magistrate, Sherghati at gaya.

With the above observation this application is disposed of.
