Heard the parties.
The petitioner is apprehending her arrest in a case registered for the offence punishable under Sections 384/386 of the Indian Penal Code.
The F.I.R. relates to an occurrence of demand of ransom from the referred mobile. The mobile phone was of the petitioner. Petitioner has stated on oath that she is an unmarried girl. While she was going to attend class, she lost her mobile phone and due to fear of the parents, she did not disclose the same to anyone.
Considering the facts aforesaid, let the petitioner,
Patna High Court CR. MISC. No.27789 of 2020(2) dt.26-11-2020 2/2 above named, in the event of her arrest or surrender before the court below within a period of thirty days from the date of receipt of the order, be released on anticipatory bail on furnishing bail bond of Rs. 20,000/- (rupees twenty thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending in connection with Siwan Muffasil (Mahadeva O.P.) P.S. Case No. 364 of 2019, subject to the condition as laid down under Section 438
(2) of the Code of Criminal Procedure as well as subject to the following conditions:
(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.
(b) The petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner. (c) The petitioner shall not leave the country without permission of the trial Court.
